SENATE CONCURRENT
RESOLUTION
REQUESTING A SUNRISE REVIEW TO DETERMINE WHETHER each county should administer a permit program for large scale dog breeders.
WHEREAS, the documented problems associated with the large scale breeding of dogs include over breeding, inbreeding, minimal veterinary care, poor quality of food and shelter, overcrowded cages, unsanitary conditions, and the killing of unwanted animals; and
WHEREAS, the large scale breeding of dogs may lead to the sale of unhealthy dogs to unsuspecting consumers; and
WHEREAS, many of the puppies for sale in pet shops are the offspring of dogs maintained by large scale breeders in brutal conditions; and
WHEREAS, Hawaii is one of the few states where puppy mills are allowed to flourish because of a lack of permitting and buyer recourse; and
WHEREAS, establishing a permit program for large scale dog breeders would help reduce cruelty to dogs and protect consumers; and
WHEREAS, a permit program would provide, at minimum, for inspection of the breeding facility to ensure adequacy and cleanliness, information regarding the number of puppies born, and the payment of licensing fees; and
WHEREAS, S.B. No. , introduced during the Regular Session of 2012, requires that, in order to operate a large scale dog breeding operation, a person shall possess a valid dog breeder permit issued by the appropriate county animal control officer or agency; and
WHEREAS, under section 26H-6, Hawaii Revised Statutes, measures that would subject unregulated professions and occupations to licensing or other regulatory controls cannot be enacted unless the Auditor has conducted a sunrise review of the specific measure identified through a concurrent resolution; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2012, the House of Representatives concurring, that the Auditor is requested to perform a sunrise review of the regulation of large scale dog breeders by the various counties as contemplated under S.B. No. , introduced during the Regular Session of 2012; and
BE IT FURTHER RESOLVED that the Auditor is requested to submit to the Legislature a report on any findings and recommendations, including proposed legislation, not later than twenty days prior to the convening of the Regular Session of 2013; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and to the mayor and the chairperson of the legislative body of each county.
