A BILL FOR AN ACT

 

 

relating to elections.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The office of elections shall establish a pilot project to enable Hawaii registered voters with permanent absentee voter status pursuant to section 15-4, Hawaii Revised Statutes, to vote in Hawaii elections via the Internet.  The pilot project shall be for a period of two election cycles, beginning with the 2014 elections.

     SECTION 2.  (a)  The office of elections shall:

     (1)  Create and implement an internet voting pilot project that is at least as secure from tampering as the current absentee voting process;

     (2)  Make the internet voting project available to all Hawaii registered voters with permanent absentee voter status on the date of any primary and general election occurring during the period of the pilot project;

     (3)  Work with the clerk of each county in the development and implementation of the internet voting pilot project; and

     (4)  Adopt rules necessary to implement this Act in accordance with chapter 91, Hawaii Revised Statutes.

     (b)  The chief election officer shall be responsible for educating registered voters with permanent voter status and the public with respect to the internet voting pilot project.

     SECTION 3.  The office of elections shall submit a preliminary report to the legislature at least twenty days prior to the convening of the 2014 and 2015 regular sessions and a final report to the legislature at least twenty days prior to the convening of the 2017 regular session regarding the pilot project, including but not limited to:

     (1)  The status of the pilot project, including plans for and implementation of the internet voting pilot project, and any problems or issues with respect to the plans and implementation of the internet voting pilot project;

     (2)  The number of participants in the pilot project;

     (3)  A description of any public voter education efforts relating to the internet voting pilot project;

     (4)  Any recommendations regarding whether the internet voting pilot project should continue or be terminated; and

     (5)  Any recommended legislation.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the implementation of an internet voting pilot project.

     The sums appropriated shall be expended by the office of elections for the purposes of this Act.

     SECTION 5.  This Act shall take effect on July 1, 2013.
