A BILL FOR AN ACT

 

 

RELATING TO EDUCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Hawaii has a unique, statewide public education system.  The state educational agency and local education agency are one and the same, and its leadership requires a unique perspective and experience.  Hawaii is also the only state that provides all public school funding without any additional support from the counties.

     The purpose of this Act is to require that the board of education prioritize, for the superintendent of education position, candidates that have the minimum qualification of ten years of employment in the department of education, with at least five of those years serving in the position of teacher, principal, or higher and establish, as a desired qualification for a candidate, having a working understanding of Hawaii's tri-level systems of educational administration.

     SECTION 2.  Section 302A-1101, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The board shall appoint, and may remove, the superintendent by a majority vote of its members.  The superintendent:

     (1)  May be appointed without regard to the state residency provisions of section 78-1(b);

     (2)  May be appointed for a term of up to four years; and

     (3)  May be terminated only for cause[.];

provided that, notwithstanding any law to the contrary, for the position of superintendent, the board shall prioritize candidates that have a minimum of ten years of employment in the department of education, with at least five of those years serving in the position of teacher, principal, or higher; provided further that a desired qualification for a candidate for the position of superintendent shall be a working understanding of Hawaii's tri-level systems of educational administration.  For purposes of this subsection, "tri-level systems of educational administration" refers to the systems of administration at the State, complex area, and school levels."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.

Description:

Requires that the board of education prioritize for the superintendent of education position candidates that have minimum of ten years of employment in the department of education, with at least five of those years serving in the capacity as a teacher, principal, or higher.  Establishes a working understanding of the State's tri-level systems of educational administration as a desired qualification for candidates for the superintendent of education position.  Effective 7/1/2050.  (HD1)
