A BILL FOR AN ACT

 

 

relating to malpractice insurance.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 451D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§451D-     Malpractice insurance; required.  In addition to any other requirements for licensure, no health care professional may serve as a primary care provider to any person unless the health care professional maintains malpractice insurance in an amount to be determined by the insurance commissioner; provided that any minimum insurance amount determined by the insurance commissioner shall apply to all health care professionals subject to this chapter, regardless of their professional specialty or certification."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval and shall apply to persons obtaining their initial license or renewing an existing license on or after January 1, 2018.
