A BILL FOR AN ACT

 

 

relating to species conservation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 195D-26, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§195D-26[]]  Annual report; endangered species.  The department, after consultation with the endangered species recovery committee, by December 31 of each year, shall prepare a report [summarizing:] detailing:

     (1)  The impacts of all incidental take licenses issued pursuant to sections 195D-4 and 195D-22 since          , including the status of all endangered, threatened, proposed, and candidate species for which incidental take licenses [pursuant to sections 195D-4 and 195D-22] have been issued [and]; the effect each incidental take license issued has had on increasing or decreasing the likelihood of survival of the species for which the license was issued; the cumulative impacts on the full range of species of the particular island for which an incidental take license was issued; and the effectiveness of all habitat conservation plans and safe harbor agreements that have been approved;

     (2)  The condition of the trust fund established under this chapter, including receipts and expenditures over the previous fiscal year; and

     (3)  Any recommendations to further the purposes of this chapter.

The report and all information pertaining to incidental take licenses shall be available to the public."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $            or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 for the department of land and natural resources to assess the impacts of incidental take licenses issued pursuant to sections 195D-4 and 195D-22, Hawaii Revised Statutes, and to detail those impacts in its annual report pursuant to section 195D-26, Hawaii Revised Statutes.

     The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval; provided that section 2 shall take effect on July 1, 2017.

Report Title:

Endangered Species; Incidental Take Licenses; Cumulative Effects; Likelihood of Survival; Department of Land and Natural Resources; Appropriation

 

Description:

Requires the Department of Land and Natural Resources to include in its annual report the impacts of incidental take license issuances on the status and likelihood of survival of the individual species and the cumulative impacts on the full range of species of the specific island for which incidental take licenses have been issued.  Appropriates funds to the department to assess the cumulative effects and detail them in its annual report.
