A BILL FOR AN ACT

 

 

relating to electric hydrofoil surfboards.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§200-     Electric hydrofoil surfboard permit.  (a)  In addition to any other requirement as provided by law, no electric hydrofoil surfboard shall be operated without a permit.

     (b)  Each permit shall restrict the operation of an electric hydrofoil surfboard to be outside a designated distance from the shore and for a limited duration; provided that permits shall not be issued to allow for:

     (1)  The concurrent operation of more than three electric hydrofoil surfboards at the same designated beach and designated period of time; and

     (2)  The operation of electric hydrofoil surfboards in violation of sections 200-37(i) and 200-38(c).

     (c)  Permits under this section shall be issued by the counties.  Counties shall have sole discretion for determining the manner in which shores are partitioned for purposes of this section and may deny the operation of electric hydrofoil surfboards at specific beaches, along certain lengths of a shore, or during certain periods of time.

     (d)  Fees for permits shall be determined by the counties and payable to the counties.

     (e)  The counties and the department shall collaborate to enforce this section."

     SECTION 2.  Section 200-37, Hawaii Revised Statutes, is amended by amending subsection (i) to read as follows:

     "(i)  Between December 15 and May 15 of each year, no person shall operate a thrill craft[,] or electric hydrofoil surfboard, or engage in parasailing, water sledding, or commercial high speed boating, or operate a motor vessel towing a person engaged in water sledding or parasailing on the west and south shore of Maui as provided in section 200-38."

     SECTION 3.  Section 200-38, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  Notwithstanding any other law to the contrary, no person shall operate a thrill craft, operate an electric hydrofoil surfboard, engage in parasailing, operate a motorized vessel towing a person engaged in parasailing, engage in commercial water sledding or commercial high speed boating, or operate a commercial motor vessel towing a person engaged in water sledding between December 15 and May 15 of each year in the waters of west and south Maui from Pu`u Ola`i to Hawea Point."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2021.
