A BILL FOR AN ACT

 

 

Relating to Public Safety.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Act 139, Session Laws of Hawaii 2012, section 14, as amended by Act 67, Session Laws of Hawaii 2013, section 2, as amended by Act 231, Session Laws of Hawaii 2016, section 69, is amended to read as follows:

     "SECTION 14.  This Act shall take effect on July 1, 2012; provided that:

     (1)  Section 3 shall take effect on January 1, 2013;

     (2)  Section 7 shall take effect on July 1, 2012, for any individual on parole supervision on or after July 1, 2012; and

     (3)  Section 8 shall take effect on July 1, 2012, and shall be applicable to individuals committing an offense on or after that date[; and

     (4)  Sections 3, 7, 8, and 11 shall be repealed on July 1, 2018, and sections 353-10, 353-66, 706-670(1), and 353-69, Hawaii Revised Statutes, shall be reenacted in the form in which they read on June 30, 2012]."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Public Safety; Pre-Trial Risk Assessment; Parole; Sunset; Repeal

 

Description:

Deletes the sunset provision for Act 139, Session Laws of Hawaii 2012, to make permanent provisions of the Act regarding pretrial risk assessments and parole.
