A BILL FOR AN ACT
relating to minimum wage.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 387, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§387- Minimum
wage commission. (a)
There is established within the department of labor and industrial
relations a minimum wage commission, for administrative purposes only. Members of the commission shall include but not
be limited to the following:
(1) The director of labor and industrial relations or the director's designee;
(2) The director of
human services or the director's designee;
(3) Two members
appointed by the governor;
(4) Two members
appointed by the president of the senate;
(5) Two members
appointed by the speaker of the house of representatives; and
(6) Three other
representatives appointed by the governor from other organizations that may
assist in providing necessary expertise.
(b) Vacancies in a
position shall be filled in the same manner as that member's appointment. The members of the commission shall serve
without compensation but may be reimbursed for necessary expenses, including
travel expenses, incurred in the discharge of their duties.
(c) The commission
shall review and recommend an appropriate minimum wage.
(d) Before the twentieth legislative day of the
regular session of 2022 and every year thereafter, the commission shall study
and make recommendations for any increase in the minimum wage and the recommended
effective date of the increase; provided that the recommended effective date shall
be no earlier than the adjournment of the legislative session following the commission's recommendation. A recommended increase by the commission shall
be effective as of the date set forth in the recommendation unless the
legislature disapproves the recommendation by adoption of a concurrent
resolution prior to adjournment sine die of the legislative session in which
the recommendation was submitted."
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2021-2022 and the same sum or so much thereof as may be necessary for fiscal year 2022-2023 for the administration of the minimum wage commission pursuant to this Act.
The sums appropriated shall be expended by the
department of labor and industrial relations for the purposes of this Act.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval; provided that section 2 shall take effect on July 1, 2021.
