A BILL FOR AN ACT

 

 

Relating to FIRE SPRINKLERS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§46-    Fire sprinkler system inspections; housing projects.  No county shall charge for the inspection of automatic fire sprinklers or automatic fire sprinkler systems in any housing project, as defined in section 201H-1, under the jurisdiction of the Hawaii housing finance and development corporation."

     SECTION 2.  Chapter 201H, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§201H-    Housing projects; fire sprinkler system inspections.  Pursuant to section 46-  , no county shall charge for the inspection of automatic fire sprinklers or automatic fire sprinkler systems in any housing project, as defined in section 201H-1, under the jurisdiction of the corporation."

     SECTION 3.  Section 46-19.8, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§46‑19.8[]]  Fire sprinklers; residences.  No county shall require the installation or retrofitting of automatic fire sprinklers or an automatic fire sprinkler system in[:

     (1)  Any] any new or existing detached one- or two-family dwelling unit in a structure used only for residential purposes; [and

     (2)  Nonresidential agricultural and aquacultural buildings and structures located outside an urban area;]

provided that this section shall not apply to new homes that require a variance from access road or firefighting water supply requirements."

     SECTION 4.  Act 83, Session Laws of Hawaii 2012, is amended by amending section 3 to read as follows:

     "SECTION 3.  This Act shall take effect on July 1, 2012[; provided that on June 30, 2017, this Act shall be repealed]."

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.


     SECTION 6.  This Act shall take effect on June 29, 2017.

Description:

Prohibits counties from charging for automatic fire sprinkler or automatic fire sprinkler system inspections in any HHFDC housing projects.  Makes permanent the prohibition on counties from requiring installation or retrofitting of automatic fire sprinklers in new or existing one‑ or two‑family dwelling units used only for residential purposes.  Repeals the prohibition on counties from requiring installation or retrofitting of automatic fire sprinklers in nonresidential agricultural and aquacultural buildings and structures located outside an urban area.  Takes effect on June 29, 2017.
