A BILL FOR AN ACT

 

 

Relating to construction management.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established within the department of transportation a three-year construction management consultant procurement pilot program, that shall require the department of transportation to procure professional services by construction management consultants using competitive sealed bidding and competitive sealed proposals pursuant to sections 103D-302 and 103D-303, Hawaii Revised Statutes; provided that the pilot program shall not apply to emergency procurements obtained pursuant to section 103D-307, Hawaii Revised Statutes.

     (b)  The department of transportation may adopt temporary rules pursuant to chapter 91, Hawaii Revised Statutes, regarding the establishment and operation of the pilot program.

     SECTION 2.  (a)  No later than twenty days prior to the convening of the regular session of 2023, the department of transportation shall submit a preliminary report to the legislature of its findings regarding the implementation of the construction management consultant procurement pilot program.  The report shall include a detailed chart that lists the construction projects for which the department has procured a construction management consultant, the method of procurement used, the cost of the project, whether the construction management consultant was licensed, and other relevant information.

     (b)  No later than twenty days prior to the convening of the regular session of 2024, the department of transportation shall submit an interim report to the legislature of its findings regarding the construction management consultant procurement pilot program.  The interim report shall include:

     (1)  Any benefits from using the competitive sealed bidding and competitive sealed proposals methods of procurement to procure the professional services of construction management consultants; and

     (2)  Any issues arising from using these forms of procurement.

     (c)  No later than twenty days prior to the convening of the regular session of 2025, the department of transportation shall submit a final report to the legislature of its findings and recommendations, including any proposed legislation, regarding the use of competitive sealed bidding and competitive sealed proposals to procure professional services from construction management consultants.  The report shall include a recommendation of whether competitive sealed bidding and competitive sealed proposals should continue to be used to procure the professional services of construction management consultants.

     SECTION 3.  This Act shall take effect upon its approval.
