A BILL FOR AN ACT

 

 

RELATING TO TRANSPORTATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to:

     (1)  Establish long-term goals for zero emissions transportation in Hawaii and abroad to reduce and eliminate transportation emissions;

     (2)  Establish an interisland transportation working group comprising government agencies and expert stakeholders to develop plans and recommendations for achieving zero emissions interisland transportation; and

     (3)  Establish an electric vehicle sales growth working group to develop plans to ensure sufficient support for the growing use of electric vehicles in the State.

     SECTION 2.  Chapter 225P, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

     "PART    .  HAWAII CLEAN TRANSPORTATION INITIATIVE

     §225P-A  Hawaii clean transportation initiative; established.  (a)  It shall be the goal of the State to reduce greenhouse gas emissions and achieve zero emissions across all transportation modes within the State, including across all sectors of:

     (1)  Ground transportation, as soon as practicably possible;

     (2)  Interisland transportation, as soon as practicably possible; and

     (3)  International transpacific transportation, as soon as practicably possible.

     (b)  Each applicable department, board, and commission shall endeavor to achieve the goals established in this section.

     §225P-B  Interisland transportation working group; established.  (a)  There is established an interisland transportation working group within the department of transportation for administrative purposes.

     (b)  The working group shall:

     (1)  Develop metrics, benchmarks, plans, and recommendations for stakeholders and the legislature to achieve the goals of section 225P-A(a)(2);

     (2)  Coordinate with other groups, agencies, and programs in the State and outside of the State that are working to achieve zero emissions transportation; and

     (3)  Coordinate with the State and applicable stakeholders to pursue grants and other funding opportunities to achieve the goals of section 225P-A(a)(2).

     (c)  The working group shall comprise the following members:

     (1)  The director of transportation, or the director's designee, who shall serve as co-chairperson of the working group;

     (2)  The chief energy officer of the Hawaii state energy office, or the chief energy officer's designee, who shall serve as co-chairperson of the working group;

     (3)  The co-chairpersons of the commission, or the co‑chairpersons' designees;

     (4)  The mayor of each county, or the mayor's designee;

     (5)  One representative from the airline industry to be selected by the co-chairs;

     (6)  One representative from the cruise line industry to be selected by the co-chairs;

     (7)  One representative from an entity involved in developing sustainable transportation solutions to be selected by the co-chairs;

     (8)  One representative from the Honolulu harbor users group to be selected by the co-chairs; and

     (9)  Relevant stakeholders, as recommended by the working group.

     (d)  The working group shall:

     (1)  Submit an annual report to the commission on the working group's activities, progress, and any recommendations to achieve the goals of section 225P‑A(a)(2); and

     (2)  Submit a report on the progress made and any recommendations to achieve the goals of section 225P‑A(a)(2), including any proposed legislation, to the legislature no later than twenty days prior to the convening of each regular session.

     §225P-C  Electric vehicle sales growth working group; department of transportation; requirements.  (a)  There is established an electric vehicle sales growth working group within the department of transportation for administrative purposes.

     (b)  The working group shall:

     (1)  Develop plans to ensure that the State's electric charging capacity is sufficient to support the growing use of electric vehicles in the State by increasing the State's electric charging capacity at a rate that exceeds the rate by which electric vehicle sales replace internal combustion vehicle sales;

     (2)  Allow continued access to high-occupancy vehicle lanes by electric vehicles until electric vehicles constitute at least twenty-five per cent of all new vehicle sales; and

     (3)  Develop incentives to further promote the adoption of electric vehicles.

     (c)  The working group shall comprise the following members:

     (1)  The director of transportation, or the director's designee, who shall serve as co-chairperson of the working group;

     (2)  The chief energy officer of the Hawaii state energy office, or the chief energy officer's designee, who shall serve as co-chairperson of the working group;

     (3)  The mayor of each county, or the mayor's designee;

     (4)  One representative from an automobile dealers association to be selected by the co-chairs;

     (5)  One representative from the car and automobile manufacturing industry to be selected by the co-chairs;

     (6)  One representative from a public utility to be selected by the co-chairs;

     (7)  One representative from an electric vehicle association to be selected by the co-chairs;

     (8)  One representative from the ground transportation industry to be selected by the co-chairs; and

     (9)  Relevant stakeholders, as recommended by the working group.

     (d)  The working group shall:

     (1)  Submit an annual report to the commission on the working group's activities, progress, and any recommendations related to achieving the objectives pursuant to subsection (b); and

     (2)  Submit a report on the progress made and any recommendations related to achieving the objectives pursuant to subsection (b), including any proposed legislation, to the legislature no later than twenty days prior to the convening of each regular session.

     §225P-D  Rulemaking.  The department of transportation and Hawaii state energy office may adopt rules pursuant to chapter 91 to effectuate this part."

     SECTION 3.  Chapter 225P, Hawaii Revised Statutes, is amended by designating sections 225P-1 to 225P-7, Hawaii Revised Statutes, as part I, entitled "General Provisions".

     SECTION 4.  In codifying the new sections added by section 2 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 5.  This Act shall take effect upon its approval.
