A BILL FOR AN ACT
relating to pesticides.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 149A-36, Hawaii Revised Statutes, is amended to read as follows:
"§149A-36 Authority to inspect.
The department or any authorized representative or employee of the department or
any county pesticide inspection employee or authorized representative may
enter upon any public or private property, according to law at any reasonable
time to examine and inspect application methods and equipment, to examine and
collect samples of plants, soil, and other materials, and to perform any other
duty for the purpose of carrying out and effectuating the purposes of this
chapter[.] and any county pesticide inspection ordinance.
Nothing in this section shall preclude any county from implementing a pesticide inspection program or conducting pesticide inspections as may be mandated by county ordinance or authority delegated to any county under state law."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
