A BILL FOR AN ACT

 

 

relating to schools.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Scientists predict that the world is due for an influenza pandemic — a global outbreak from a new strain of influenza.  The United States Department of Education is collaborating with health experts and agencies across the federal government to ensure that, in the case of pandemic flu, operations and services will continue.  State and local preparedness will be crucial in preventing the spread of disease.  Because schools are centers of community life, educators and administrators should work with local officials to make planning for pandemic flu, or other pandemic, a priority.  Strategies and plans must be developed to assist in disseminating health information, planning for staff and student absences, and maintaining a learning environment.

     The purpose of this Act is to provide for the public health and safety by requiring every school to develop its own pandemic preparedness plan and post the plan on the department of education's website.

     SECTION 2.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A‑      School pandemic preparedness plan.  (a)  Each school shall develop a pandemic preparedness plan that shall be posted on the department's website.

     (b)  The plan shall include:

     (1)  Coordination with the community's pandemic preparedness plan as well as the state department of education and health's pandemic preparedness plans;

     (2)  Accountability and responsibility as well as resources for key stakeholders engaged in planning and executing specific components of the operational aspects of the plan;

     (3)  Timelines, deliverables, and performance measures;

     (4)  Implementation of an exercise or drill to test the pandemic preparedness plan and to revise it periodically; and

     (5)  Requirements for students with special needs, low income students who rely on the school food service for daily meals, students in special facilities including juvenile justice facilities, and students who do not speak English as their first language."

     SECTION 3.  Chapter 302B, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302B‑    School pandemic preparedness plan.  (a)  Each charter school shall develop a pandemic preparedness plan that shall be posted on the department's website.

     (b)  The plan shall include:

     (1)  Coordination with the community's pandemic preparedness plan as well as the state department of education and health's pandemic preparedness plans;

     (2)  Accountability and responsibility as well as resources for key stakeholders engaged in planning and executing specific components of the operational aspects of the plan;

     (3)  Timelines, deliverables, and performance measures;

     (4)  Implementation of an exercise or drill to test the pandemic preparedness plan and to revise it periodically; and

     (5)  Requirements for students with special needs, low income students who rely on the school food service for daily meals, students in special facilities including juvenile justice facilities, and students who do not speak English as their first language."

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
