A BILL FOR AN ACT

 

 

relating to the school FACILITIES AUTHORITY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Act 72, Session Laws of Hawaii 2020, established a school facilities agency to be a body corporate and a public instrumentality of the State for the purposes of being responsible for public school development, planning, and construction related to capital improvement projects assigned to the legislature, governor, or board of education.  The legislature further finds that Act 217, Session Laws of Hawaii 2021, renamed the agency as the school facilities authority.

     The purpose of this Act is to:

     (1)  Require the school facilities authority established under section 302A-1702, Hawaii Revised Statutes, to adopt and publish administrative rules necessary to implement Act 72, Session Laws of Hawaii 2020, as amended by Act 217, Session Laws of Hawaii 2021, by July 1, 2022; and

     (2)  Require the office of the governor to provide a report to the legislature regarding the process by which the school facilities authority purchases real property and executes capital improvement project contracts.

     SECTION 2.  (a)  The school facilities authority shall adopt and publish its administrative rules in accordance with chapter 91, Hawaii Revised Statutes, as necessary to implement Act 72, Session Laws of Hawaii 2020, as amended by Act 217, Session Laws of Hawaii 2021, by July 1, 2022.

     (b)  The office of the governor shall submit a report documenting the process by which the school facilities authority purchases real property and executes capital improvement project contracts to the legislature no later than twenty days prior to the convening of the regular session of 2022.

     SECTION 3.  This Act shall take effect upon its approval.
