A BILL FOR AN ACT

 

 

RELATING TO GOVERNMENT PUBLICATIONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 93-2, Hawaii Revised Statutes, is amended by amending the definition of "publication" to read as follows:

     ""Publication" means informational matter produced for public distribution or access in any tangible medium, including electronic or digital means, originating or produced with the imprint of, by the authority of, or at the total or partial expense of any agency of the State or a county government.  "Publication" does not include manuals, calendars, schedules, correspondence, or forms intended strictly for in-house use of governmental agencies, scholarly publications of the University of Hawaii press, and materials developed by the department of education specifically for instructional use with students."

     SECTION 2.  Section 93-3, Hawaii Revised Statutes, is amended to read as follows:

     "§93-3  Deposit of publications.  (a)  Upon release of a publication, every state and county agency shall immediately deposit [two paper copies, and] one electronic copy in a format prescribed by the state librarian, with the state publications distribution center and one [paper] electronic copy with the University of Hawaii.  Additional paper copies of the publications shall be deposited with the publications distribution center upon request of a representative of that center so long as copies are available.

     (b)  The state librarian, state publications distribution center, and the University of Hawaii shall make available to the public an electronic or digital copy of any publication deposited pursuant to this section, unless a paper copy is requested.

     (c)  The state librarian may enter into depository agreements with private and public educational, historical, or scientific institutions or other libraries, within or without the State, in order to achieve the objectives sought under this part[.]; provided that any depository agreement shall provide for the deposit of publications in electronic or digital means unless the institution or library requests paper copies."

     SECTION 3.  Section 93-4, Hawaii Revised Statutes, is amended to read as follows:

     "§93-4  Depository library system.  The state librarian shall designate at least one government publications depository in each county and shall distribute to each depository one electronic copy of each publication, as defined in this part.  The state librarian shall deposit paper copies only upon the request of a government publications depository."

     SECTION 4.  Section 93-11, Hawaii Revised Statutes, is amended to read as follows:

     "§93-11  Disposition of statutes and court reports.  In addition to the copies of Hawaii Revised Statutes and Hawaii reports that may be disposed of by sale, exchange, or presentation to public officers for official use, copies of each volume may be presented to libraries of educational, historical, or scientific institutions or other libraries of a public or quasi-public nature in the State and elsewhere[.] through electronic or digital means, unless paper copies are requested."

     SECTION 5.  Section 93-16, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  Notwithstanding any other statute, law, charter provision, ordinance, or rule to the contrary, whenever a government agency is required to submit a report to the legislature, the report shall be:

     (1)  Available in [printed] electronic or digital form;

     (2)  Submitted in [printed] electronic or digital form to the president of the senate, the speaker of the house of representatives, and the legislative reference bureau library[;], unless printed copies are requested; and

     (3)  Posted on the designated central State of Hawaii website; or

     (4)  Posted on the Internet in an easily-located manner."

     SECTION 6.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 7.  This Act shall take effect upon its approval.
