A BILL FOR AN ACT

 

 

relating to fireworks.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There shall be established within the department of public safety for administrative purposes an illegal fireworks task force.  The task force shall:

     (1)  Develop a plan and make recommendations to regulate and control the spread of illegal fireworks in the State;

     (2)  Investigate black market sources to stop the influx of illegal fireworks into and throughout the State;

     (3)  Develop and promote education-based prevention efforts to raise awareness about the dangers illegal fireworks pose;

     (4)  Collaborate with relevant state and federal agencies to bolster task force operations; and

     (5)  Evaluate the feasibility of using location-detection and web-based reporting technology to reduce the number of fireworks-related offenses.

     (b)  The department of public safety shall provide administrative support to the illegal fireworks task force.

     (c)  The task force shall consist of the following members or their designees:

     (1)  The director of public safety, who shall serve as the chair of the task force;

     (2)  The fire chief of each county;

     (3)  The chief of police of each county;

     (4)  The prosecuting attorney of each county;

     (5)  The state attorney general; and

     (6)  Any other first responder, public safety, or state agency officers the director of public safety deems necessary.

     The members shall not receive compensation for their services.

     (d)  The task force shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2023.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2022-2023 to establish the illegal fireworks task force.

     The sum appropriated shall be expended by the department of public safety for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2022.
