A BILL FOR AN ACT
RELATING TO EDUCATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 302A-854, Hawaii Revised Statutes, is amended to read as follows:
"§302A-854 School health aides;
compensation[.]; training. (a) All
full-time school health aides employed in the department shall be employed and
have their compensation fixed in accordance with chapter 76 and the appropriate
collective bargaining agreement, executive order, executive directive, or rule.
(b) All school health aides shall be trained and provided clinical direction by the department of health in consultation with the University of Hawaii school of nursing and dental hygiene."
SECTION 2. Section 302A-708, Hawaii Revised Statutes, is repealed.
["[§302A-708 Career development
opportunities.] The department of education shall provide career pathways
development and training opportunities to all school health aides in the school
health services field and other fields within the department of education to
ensure the opportunity for continued employment with the department of
education."]
SECTION 3. The department of education and the department of health shall enter into a memorandum of understanding on the issue of training for school health aides. The department of education and department of health shall submit a copy of the memorandum of understanding to the legislature no later than twenty days prior to the convening of the regular session of 2014.
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect on July 1, 2050; provided that section 1 shall be repealed on June 30, 2014, and section 302A-854, Hawaii Revised Statutes, shall be reenacted in the form in which it read on the day prior to the effective date of this Act.

Description:
Amends section 302A-854, HRS, to require the department of health, in consultation with the University of Hawaii school of nursing and dental hygiene, to provide training and clinical direction to school health aides until June 30, 2014. Repeals section 302A‑708, HRS, which requires the department of education to provide career pathways development and training opportunities to school health aides in the department's school health services field. Requires the department of education and department of health to enter into a memorandum of understanding relating to the training of school health aides and submit a copy to the legislature no later than twenty days prior to the convening of the regular session of 2014. Effective 7/1/2050. (SD2)
