A BILL FOR AN ACT

 

 

relating to transportation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that as a premier tourist destination, Hawaii has an abundance of rental cars being used on its roadways on a daily basis.  The daily use of these vehicles has a detrimental impact on infrastructure and contributes to traffic congestion, especially on neighbor islands where the number of rental cars may equal or even outnumber resident-owned vehicles on any given day.

     The purpose of this Act is to establish and collect a rental motor vehicle surcharge dedicated to road improvements, maintenance, and repair in the county in which the funds are generated.

     SECTION 2.  Chapter 251, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§251  Rental motor vehicle road improvement surcharge.  (a)  There is levied and shall be assessed and collected each month a rental motor vehicle road improvement surcharge of $4.50 per day to be deposited into the state highway fund.

     The rental motor vehicle road improvement surcharge shall be levied on the lessor.

     (b)  Moneys generated by the rental motor vehicle road improvement surcharge and deposited into the state highway fund shall be used for road improvements, maintenance, and repair in the county in which the moneys are generated.  No moneys shall be expended to plan, design, improve, enhance, acquire, or construct rental motor vehicle customer facilities, equipment, or services shared or to be shared by rental motor vehicle concessions at a state airport."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
