A BILL FOR AN ACT
RELATING TO THE HAWAII MEDICAL MARIJUANA OVERSIGHT COMMISSION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. (a) There shall be established within the department of health the Hawaii medical marijuana oversight commission. The commission shall monitor, evaluate, and make recommendations regarding the implementation of the use, cultivation, and dispensing of medical marijuana and the overall Hawaii medical marijuana program.
(b) The commission shall be composed of:
(1) The director of health or the director's designee;
(2) The chairperson of the senate committee on commerce, consumer protection, and health or the chairperson's designee;
(3) The chairperson of the house of representatives committee on health or the chairperson's designee;
(4) One registered patient from each county that holds a valid medical marijuana card, to be appointed by the governor;
(5) One registered nurse to be appointed by the governor;
(6) One physician registered in the State of Hawaii to be appointed by the governor;
(7) The executive director of the Drug Policy Forum of Hawaii, or the director's designee;
(8) A representative from University of Hawaii college of tropical agriculture and human resources;
(9) A representative from the Medical Cannabis Coalition of Hawaii; and
(10) A representative from the American Civil Liberties Union.
(c) The members of the commission shall elect a chairperson from among themselves; provided that the chairperson is not a government employee. All members shall serve without compensation but shall be reimbursed for expenses, including travel expenses, necessary for the performance of their duties on the commission.
(d) The commission shall meet at least once each quarter to evaluate:
(1) The ability of qualifying patients and registered caregivers in all areas of the State to obtain timely access to medical marijuana for symptom relief;
(2) The effectiveness of registered dispensaries individually and collectively in serving the needs of qualifying patients and registered caregivers, including the provision of educational and support services;
(3) Sufficiency of the regulatory and security safeguards surrounding the use, cultivation, and dispensing of medical marijuana to ensure that access to and use of cultivated medical marijuana is provided only to registered patients or their caregivers authorized for such purposes;
(4) The overall statewide medical marijuana program and its usefulness and effectiveness with patients, caregivers, and all stakeholders; and
(5) Any other subject relating to medical marijuana as deemed necessary by the chairperson.
(e) The commission may create subcommittees to research and discuss subjects relating to medical marijuana, including:
(1) The medical use of edible manufactured marijuana products;
(2) The effectiveness of the current distribution system implemented in Hawaii as compared with distribution systems implemented in other states; and
(3) New medical conditions to be included within the medical marijuana program.
(f) In the event topics or issues related to medical marijuana arise that require special expertise, the chairperson may add additional members with expertise to the commission to work in subcommittees pursuant to subsection (e).
(g) The commission shall prepare and submit a report on its findings to the senate committee on commerce, consumer protection, and health and the house of representatives committee on health. The report shall be submitted at least twenty days prior to the convening of each regular legislative session until the commission ceases to exist.
(h) The commission shall cease to exist on July 1, 2022.
SECTION 2. This Act shall take effect on January 1, 2017.
