A BILL FOR AN ACT

 

 

RELATING TO ELECTRIC VEHICLES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 107-25, Hawaii Revised Statutes, is amended to read as follows:

     "§107-25  Hawaii state building codes; requirements.  (a)  There is established the Hawaii state building codes applicable to all construction in the State of Hawaii.  The Hawaii state building codes shall be based upon:

     (1)  The state fire code as adopted by the state fire council;

     (2)  The Uniform Plumbing Code, as copyrighted and published by the International Association of Plumbing and Mechanical Officials, including its appendices;

     (3)  The International Building Code, the International Residential Code, and the International Energy Conservation Code, as published by the International Code Council;

     (4)  The National Electrical Code, as published by the National Fire Protection Association;

     (5)  Hawaii design standards implementing the criteria pursuant to Act 5, Special Session Laws of Hawaii, 2005, as applicable to:

          (A)  Emergency shelters built to comply with hurricane resistant criteria, including enhanced hurricane protection areas capable of withstanding a five hundred-year hurricane event as well as other storms and natural hazards; and

          (B)  Essential government facilities requiring continuity of operations; and

     (6)  Code provisions based on nationally published codes or standards that include but are not limited to residential and hurricane resistant standards related to loss mitigation standards in accordance with section 431P-12, elevator, mechanical, flood and tsunami, existing buildings, and onsite sewage disposal.

     (b)  After July 1, 2018, any Hawaii state building codes adopted pursuant to subsection (a)(3) shall require that at least twenty-five per cent of parking stalls of residential multi-unit buildings that have twenty or more parking stalls and commercial buildings that have forty or more parking stalls be electric vehicle charger ready.  As used in this section, "electric vehicle charger ready" means having sufficient wire, conduit, electrical panel service capacity, overcurrent protection devices, and suitable termination points to connect to an electric vehicle charger capable of providing a minimum of nine kilowatts of electrical capacity."

     SECTION 2.  Act 168, Session Laws of Hawaii 2012, section 2, is amended by amending subsection (b) to read as follows:

     "(b)  An electric vehicle on which an electric vehicle license plate is affixed shall be exempt from payment of parking fees[, including those collected through parking meters,] charged by any state or county authority in this State[, except]; provided that [this exemption shall not apply]:

     (1)  For [more than] metered parking stalls, this exemption shall be limited to two and one-half hours [of metered parking], or the maximum amount of time the meter allows, whichever is longer; [or]

     (2)  [To parking fees assessed in increments longer than one twenty-four hour day, including weekly, monthly, or annual parking permits.] For non-metered parking stalls, this exemption shall be limited to the initial twenty-four hours of use of the parking stall under any daily, weekly, monthly, or annual parking permit or similar agreement; and

     (3)  For non-metered parking at all state airports under the jurisdiction of the department of transportation, the maximum allowable time for the exemption shall be limited to twenty-four hours, after which time the parking fee shall be the applicable regular per hour fee or regular daily or monthly parking fee, as applicable; provided further that the department shall not charge a card activation fee if the parking is by the month."

     SECTION 3.  (a)  The department of transportation may adopt rules pursuant to chapter 91, Hawaii Revised Statutes, for the registration of, and issuance of special license plates for, electric vehicles.

     (b)  An electric vehicle on which an electric vehicle license plate is affixed shall be exempt from payment of parking fees charged by any state authority; provided that:

     (1)  For metered parking stalls, this exemption shall be limited to two and one-half hours, or the maximum amount of time the meter allows, whichever is longer;

     (2)  For non-metered parking stalls, this exemption shall be limited to the initial twenty-four hours of use of the parking stall under any daily, weekly, monthly, or annual parking permit or similar agreement; and

     (3)  For non-metered parking at all state airports under the jurisdiction of the department of transportation, the maximum allowable time for the exemption shall be limited to twenty-four hours, after which time the parking fee shall be the applicable regular per hour fee or regular daily or monthly parking fee, as applicable; provided further that the department shall not charge a card activation fee if the parking is by the month.

     (c)  An electric vehicle on which an electric vehicle license plate is affixed shall be exempt from high occupancy vehicle lane restrictions.

     (d)  As used in this section, "electric vehicle" means:

     (1)  A neighborhood electric vehicle; or

     (2)  A vehicle, with four or more wheels, that draws propulsion energy from a battery with at least four kilowatt hours of energy storage capacity that can be recharged from an external source of electricity.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on January 28, 2045; provided that section 3 of this Act shall take effect on June 30, 2020, and shall be repealed on June 30, 2024.

Electric Vehicles; Parking Fee; Exemptions; Airport Parking Limitations

 

Description:

Requires 25% of parking for certain residential multi-unit buildings and commercial buildings built after 7/1/2018 be electric vehicle charger ready.  Clarifies the existing parking fee exemption for electric vehicles and specifies application at state airports.  Extends the parking fee exemption for parking fees charged by state authorities until 6/30/2024.  (SB2122 HD1)
