A BILL FOR AN ACT

 

 

relating to drone operator liability insurance.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 489J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§489J-    Drone operator liability insurance.  (a)  No person shall own, operate, or control a drone unless the person maintains at all times liability insurance in the amount of not less than $        .

     (b)  A violation of this section shall constitute an unfair or deceptive act or practice under section 480-2.

     (c)  As used in this section:

     "Drone" means a powered, aerial vehicle that carries or is equipped with a recording device that:

     (1)  Does not carry a human operator;

     (2)  Uses aerodynamic forces to provide vehicle lift;

     (3)  Can fly autonomously or be piloted remotely;

     (4)  Can be expendable or recoverable; and

     (5)  Can carry a lethal or nonlethal payload."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
