A BILL FOR AN ACT

 

 

RELATING TO SMOKING ON SIDEWALKS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 328J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§328J-     Prohibition on sidewalks.  Smoking shall be prohibited on all sidewalks, as defined in section 291C-1."

     SECTION 2.  Section 328J-12, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  A person who smokes in an area or on a sidewalk where smoking is prohibited by this chapter shall be guilty of a violation and fined not more than $50 to be deposited into the general fund.  The district courts may assess costs not to exceed $25 for issuing a penal summons upon any person who fails to appear at the place within the time specified in the citation issued to the person."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
