A BILL FOR AN ACT

 

 

relating to THE STATEWIDE TRAFFIC CODE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 291C-12, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  The license [or permit to drive and any nonresident operating privilege] of [the] any person [so] convicted under this section shall be revoked[.] for a period of ten years.  For purposes of this subsection, "license" shall have the same meaning as defined in section 291E-1."

     SECTION 2.  Section 291C-12.5, Hawaii Revised Statutes, is amended to read as follows:

     "§291C-12.5  Accidents involving substantial bodily injury.  (a)  The driver of any vehicle involved in an accident resulting in substantial bodily injury to any person shall immediately stop the vehicle at the scene of the accident or as close thereto as possible but shall then forthwith return to and in every event shall remain at the scene of the accident until the driver has fulfilled the requirements of section 291C-14.  Every such stop shall be made without obstructing traffic more than is necessary.

     (b)  Any person who violates subsection (a) shall be guilty of a class C felony.

     (c)  The license of any person convicted under this section shall be revoked for a period of five years.  For purposes of this subsection, "license" shall have the same meaning as defined in section 291E-1.

     [(c)] (d)  For any violation under this section, a surcharge of $250 shall be imposed, in addition to any other penalties, and shall be deposited into the neurotrauma special fund.

     [(d)] (e)  For any violation under this section, a surcharge of up to $250 may be imposed, in addition to other penalties, which shall be deposited into the trauma system special fund."

     SECTION 3.  Section 291C-12.6, Hawaii Revised Statutes, is amended to read as follows:

     "§291C-12.6  Accidents involving bodily injury.  (a)  The driver of any vehicle involved in an accident resulting in bodily injury to any person shall immediately stop the vehicle at the scene of the accident or as close thereto as possible but shall then forthwith return to and in every event shall remain at the scene of the accident until the driver has fulfilled the requirements of section 291C-14.  Every such stop shall be made without obstructing traffic more than is necessary.

     (b)  Any person who violates subsection (a) shall be guilty of a misdemeanor.

     (c)  The license of any person convicted under this section shall be revoked for a period of one year.  For purposes of this subsection, "license" shall have the same meaning as defined in section 291E-1.

     [(c)] (d)  For any violation under this section, a surcharge of $100 shall be imposed, in addition to any other penalties, and shall be deposited into the neurotrauma special fund.

     [(d)] (e)  For any violation under this section, a surcharge of up to $100 may be imposed, in addition to other penalties, which shall be deposited into the trauma system special fund."

     SECTION 4.  Section 291C-13, Hawaii Revised Statutes, is amended to read as follows:

     "§291C-13  Accidents involving damage to vehicle or property.  (a)  The driver of any vehicle involved in an accident resulting only in damage to a vehicle or other property that is driven or attended by any person shall immediately stop such vehicle at the scene of the accident or as close thereto as possible, but shall forthwith return to, and in every event shall remain at, the scene of the accident until the driver has fulfilled the requirements of section 291C-14.  Every such stop shall be made without obstructing traffic more than is necessary. 

     (b)  Any person who violates subsection (a) shall be guilty of a petty misdemeanor.

     (c)  The license of any person convicted under this section shall be revoked for a period of six months.  For purposes of this subsection, "license" shall have the same meaning as defined in section 291E-1.

     (d)  For any violation under this section, a surcharge of up to $100 may be imposed, in addition to other penalties, which shall be deposited into the trauma system special fund."

     SECTION 5.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 6.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.


     SECTION 7.  This Act shall take effect upon its approval.

Description:

Specifies that a person convicted of being involved in an accident involving death or serious bodily injury shall have the person's license revoked for ten years.  Increases the penalty for a driver who is convicted of being involved in an accident (involving substantial bodily injury, bodily injury, and damage to a vehicle or property) and who failed to stop at the scene of the accident.  Makes failure to stop a petty misdemeanor for a driver who is involved in an accident involving damage to vehicle or property.
