A BILL FOR AN ACT

 

 

relating to illegal gambling.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 712, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:

     "§712-     Forfeiture of real property; promoting gambling in the first degree.  Real property shall be ordered forfeited to the State if the real property was used by a person to promote gambling in the first degree in at least three separate incidents and the person was convicted of promoting gambling in the first degree for at least three of those incidents, subject to the requirements of chapter 712A."

     SECTION 2.  Section 712-1221, Hawaii Revised Statutes, is amended by amending subsection (1) to read as follows:

     "(1)  A person commits the offense of promoting gambling in the first degree if the person knowingly advances or profits from gambling activity by:

     (a)  Engaging in bookmaking to the extent that the person receives or accepts in any seven-day period more than five bets totaling more than $500;

     (b)  Receiving in connection with a lottery, or mutuel scheme or enterprise, money or written records from a person other than a player whose chances or plays are represented by such money or records; [or]

     (c)  Receiving or having become due and payable in connection with a lottery, mutuel, or other gambling scheme or enterprise, more than $1,000 in any seven-day period played in the scheme or enterprise[.]; or

     (d)  Hosting activities that advance gambling activity on real property."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.

Includes under the offense of promoting gambling in the first degree the act of hosting activities that advance gambling activity on real property.  Requires the forfeiture of real property to the State if the real property was used to promote gambling in the first degree by a person in at least three separate incidents and the person was convicted for at least three of those incidents.
