A BILL FOR AN ACT

relating to THE works of art special fund.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature established the state foundation on culture and the arts in 1965 as the official arts agency of the State. The mission of the foundation is to promote, perpetuate, and preserve culture and the arts in Hawaii. The duties of the foundation include convening of the Hawaii arts education partners � composed of the department of education, the colleges of education and arts and humanities of the University of Hawaii at Manoa, the Hawaii Association of Independent Schools, and the Hawaii Alliance for Art Education � to fully implement the terms of the Hawaii arts education strategic plan; and reporting of the efforts and progress in the plan implementation to the governor and legislature each year.

The foundation's arts education programs, such as arts first, artists in the schools, art bento, and poetry out loud, endeavor to strengthen arts education for students from kindergarten through twelfth grade (K-12) with a vision towards life-long learning. For years 2019 through 2023, the strategic objectives for the foundation in terms of arts education include strengthening and expanding programs and collaborations that bring high-quality arts education to the lives of students throughout the state; and enhancing partnerships with arts and education organizations to develop, align, and promote policies supporting K-12 arts education.

The foundation currently receives funding from the State through executive allotments; the works of art special fund established under section 103-8.5, Hawaii Revised Statutes; and the works of art capital improvement project fund. For fiscal year 2019, the foundation received $6,118,620 from the State.

The foundation also applies for and is awarded federal funds each year under a state partnership agreement with the National Endowment for the Arts. The partnership agreement has a one-to-one cost sharing or matching requirement, which means that the foundation will receive federal funds only for projects that receive half of its funding from State funds that are directly controlled and appropriated by the State and directly managed by the foundation. For fiscal year 2019, the foundation received $681,800 from the National Endowment for the Arts.

The works of art special fund was created to acquire works of art and to preserve and display them in public places. The fund's uses, however, are limited to the acquisition, upkeep, and storing of works of art. Existing law fails to include uses for recognition and support of local artists whose work can be nurtured and developed.

Therefore, the purpose of this Act is to expand the scope for which the works of art special fund may be used to include:

(1) The recognition and support of artists, including students, to increase the works available for acquisition; and

(2) As a contingency fund, when necessary to satisfy the matching funds requirement to receive federal funding to support works of art and artists.

SECTION 2. Section 103-8.5, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

"(b) The works of art special fund shall be used solely for the following purposes:

(1) Costs related to the acquisition of works of art, including any consultant or staff services required to carry out the art in public places and relocatable works of art programs;

(2) Site modifications, display, and interpretive work necessary for the exhibition of works of art;

(3) Upkeep services, including maintenance, repair, and restoration of works of art;

(4) Storing and transporting works of art[.];

(5) Recognizing and supporting local artists, including student artists and arts education programs in K-12 schools; and

(6) Administrative support for programs that support works of art and artists, including the provising of state matching funds when required to obtain federal funding.

For the purposes of this subsection, "K-12 school" means a school that offers any of grades kindergarten to twelve and that is a public school, as defined in section 302A-101."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
