A BILL FOR AN ACT

 

 

RELATING TO PUBLIC LANDS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The department of land and natural resources leases parcels of land to various businesses operating on Sand Island.  Sand Island is part of the State of Hawaii's public lands, as defined by section 171-2, Hawaii Revised Statutes.  The business operators on Sand Island understand the value of their business is limited because they do not have fee title of the land on which their business is located.

     The purpose of this Act is to require the department of land and natural resources to offer for sale or exchange to leaseholders parcels of Sand Island. 

     SECTION 2.  The department of land and natural resources, within one year of the effective date of this Act, shall offer parcels of Sand Island for:

     (1)  Sale, pursuant to section 171-13, Hawaii Revised Statutes; provided that the sale shall be subject to disapproval by the legislature by two-thirds vote of either the senate or the house of representatives or by majority vote of both in any regular or special session following the date of the board of land and natural resources' approval in principle of the sale; or

     (2)  Exchange, pursuant to section 171-50, Hawaii Revised Statutes;

to persons who possess a valid lease for that same parcel as of the effective date of this Act; provided that any transfer under this Act shall be subject to the requirements of chapter 171, Hawaii Revised Statutes.

     For the purpose of this Act, "person" means any individual, firm, partnership, corporation, trust, association, joint venture, organization, institution, or any other legal entity.

     SECTION 3.  This Act shall take effect upon its approval.
