A BILL FOR AN ACT
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 440G-8.1, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) Every cable operator shall provide
safe, adequate, and reliable service in accordance with applicable laws, rules,
franchise requirements, and its filed schedule of terms and conditions of service[.],
including but not limited to disclosing to customers and prospective customers:
(1) The maximum bandwidth available; and
(2) A statement that outside factors may affect the actual bandwidth received
for cable communication services."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
