HOUSE RESOLUTION

 

 

Requesting the department of health to report to the legislature information on annual injuries and deaths associated with all-terrain vehicle.

 

 

 


     WHEREAS, off-road all-terrain vehicle (ATV's) deaths and injuries have climbed over the past years due to their popularity as recreational vehicles; and

 

     WHEREAS, ATV rollovers, collisions and ejections can cause fatalities as well as serious injuries; and

 

     WHEREAS, according to the Consumer Product Safety Commission, Hawaii has had 14 ATV related deaths from 1982 through 2007; and

 

     WHEREAS, nationwide the Consumer Product Safety Commission staff has received reports of up to 151,000 injuries a year and 8,995 ATV-related deaths between 1982 and 2007; and

 

     WHEREAS, since 1998, the ATV industry has observed voluntary guidelines restricting the sale of adult-sized ATV's for use by children under age 16, but the number of children per year injured on ATV's is alarming; and

 

     WHEREAS, Hawaii, Mississippi, Montana, Wyoming, and Washington D.C. are the only areas that do not have any safety laws pertaining to ATV's; and

 

     WHEREAS, the Legislature finds that review of state statistics on ATV injuries and deaths can help it understand the problem and find ways to keep injuries and deaths to a minimum; and

 

     WHEREAS, knowledge and extent of the problem will aide in creating legislation to help keep the injuries and deaths from increasing; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, that the department of health is requested to gather annual state statistics on deaths and injuries related to all-terrain vehicles; and

 

     BE IT FURTHER RESOLVED that the department of health shall request statistics on ATV-related deaths and injuries from hospitals, clinics and private physicians; and

 

     BE IT FURTHER RESOLVED that the department of health is requested to report current and past statistics, if any, to the Legislature and also to recommend appropriate legislation to help prevent deaths and injuries; and

 

                BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Director of the Department of Health, Hawaii Medical Association, Healthcare Association of Hawaii, American Academy of Pediatrics-Hawaii, and American Orthopedic Association-Hawaii Chapter.
