HOUSE CONCURRENT

RESOLUTION

 

 

Relating to ESTABLISHING A North Road TASK FORCE TO study the transfer of North Road to the City and County of Honolulu.

 

 


     WHEREAS, the North Road, located in the Ewa Beach Community, is a public health threat and environmental danger to its residents and community; and

 

     WHEREAS, North Road poses a health and safety hazard for children that must traverse the road without bus service, lighting or sidewalks; and

 

     WHEREAS, North Road exposes the aina to continuous toxic environmental pollution from large scale dumping with no practical solution to deal with burned out vehicles and appliances; and

 

     WHEREAS, the United States Government was the original owner of the road and has been subdivided over the years and was sold with the surrounding parcels; and

 

     WHEREAS, North Road is now owned by several different entities, with one portion of the road being privately owned by a golf course that uses a tunnel underneath the road; and

 

     WHEREAS, North Road clearly is used as a public road, as it is traversed primarily by the public as the route out of Ewa from Iroquois Point; and

 

     WHEREAS, current deed holders, YHB Ewa LLC are overwhelmed by the public use and illegal dumping and cannot maintain and repair the road or sidewalks; and

 

     WHEREAS, the lack of care has resulted in dilapidated sidewalks and lighting; and

 

 

     WHEREAS, the decayed road and abandoned vehicles is a threat to public safety where children and residents could easily be injured on the road while going to school; and

 

     WHEREAS, YHB Ewa LLC has expressed a desire to transfer the property to the City and County of Honolulu; and

 

     WHEREAS, North Road is not currently in a condition to be accepted as it lacks certain requirements under state and county regulations; and

 

     WHEREAS, in spite of the fact that North Road is almost exclusively used by the public, efforts to prompt the county, state, and even the United States Navy to act in this matter have been unsuccessful to date; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Thirtieth Legislature of the State of Hawaii, Regular Session of 2020, the Senate concurring, that a task force be established to study the transfer of North Road to the City and County of Honolulu; and

 

     BE IT FURTHER RESOLVED the task force shall be established within the department of transportation and shall be comprised of the director of transportation; the director of transportation services; the director of planning and permitting; a member of the Senate whose district includes at least a portion of Ewa who shall be appointed by the Senate President; a member of the House of Representatives whose district includes at least a portion of Ewa who shall be appointed by the Speaker of the House of Representatives; a member of the Honolulu City Council whose district includes at least a portion of Ewa who shall be appointed by the Chair of the Honolulu City Council; and a member of the United States Congress whose district includes at least a portion of Ewa who shall be appointed by the Governor; and

 

     BE IT FURTHER RESOLVED the director of transportation shall invite a representative from the United States Navy and a representative from the YHB Ewa LLC corporation and any other individual whose membership in the opinion of the chairperson, would provide a benefit to the task force to become a member of the task force; and

 

BE IT FURTHER RESOLVED that the members shall serve without compensation. Members  of the task force who are public officers or employees shall receive no additional compensation for service of the task force beyond their normal compensation. No member shall be made subject to chapter 84, Hawaii Revised Statues, solely because of that member's participation on the task force; and

 

     BE IT FURTHER RESOLVED the department of transportation shall provide administrative support to the task force; and

    

BE IT FURTHER RESOLVED the task force shall submit a report of its findings and recommendations, including any proposed costs and legislation, to the legislature and the Honolulu City Council no later than twenty days prior to the convening of the 2021 regular session of the legislature; and

 

     BE IT FURTHER RESOLVED that the task force shall cease to exist on June 30, 2021; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the director of transportation; director of transportation services of the City and County of Honolulu; the director of planning and permitting of the City and County of Honolulu; the Mayor of the City and County of Honolulu; the Governor; President of the Senate; Speaker of the House of Representatives; YHB LLC Corporation; and United States Department of the Navy.
