HOUSE CONCURRENT

RESOLUTION

 

 

URGING all STATE and county AGENCIES TO INCLUDE INTERSEx and NONBINARY AS OPTIONS ON OFFICIAL DOCUMENTS THAT IDENTIFY GENDER.

 

 

 


     WHEREAS, both the United States Constitution and the Hawaii State Constitution guarantee equal protection of the law regardless of sex; and

 

     WHEREAS, Western culture has long dictated a socially-constructed binary system of gender options that forces individuals to align with one of two genders; and

 

     WHEREAS, a variety of cultures from across the globe, including Native Hawaiian, recognize more than the two genders recognized by traditional Western cultures; and

 

     WHEREAS, intersex individuals are born with any of several variations in physical sex characteristics, and according to the Office of the United Nations High Commissioner for Human Rights, "do not fit typical binary notions of male or female bodies"; and

 

     WHEREAS, Hawaii has a long history of being an equal, inclusive, and genuinely welcoming place to individuals of all identities, cultures, and backgrounds; and

 

     WHEREAS, other states, such as California, Washington, and Oregon, and other nations, such as Canada, Germany, and Australia, have already given legal recognition to intersex and nonbinary persons on government-issued identification documents; and

 

     WHEREAS, intersex and nonbinary individuals deserve to have full legal recognition and equal treatment under the law and government-issued identification documents that provide full legal recognition of their accurate gender identity; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2018, the Senate concurring, that all state and county agencies are urged to include intersex and nonbinary as options on official documents that identify gender; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor; Comptroller; Chair of the Board of Agriculture; Attorney General; Director of Finance; Director of Business, Economic Development, and Tourism; Director of Commerce and Consumer Affairs; Adjutant General; Superintendent of Education; Chair of the Hawaiian Homes Commission; Director of Health; Director of Human Resources Development; Director of Human Services; Director of Labor and Industrial Relations; Chair of the Board of Land and Natural Resources; Director of Public Safety; Director of Taxation; Director of Transportation; Chair of the Board of Regents of the University of Hawaii; President of the University of Hawaii; and mayor of each county.
