HOUSE CONCURRENT

RESOLUTION

 

 

requesting the office of planning to convene a task force to determine ways that the State can assist the city AND County of HOnolulu in deterring the construction of monster homes.

 

 

 


WHEREAS, Hawaii neighborhoods have seen an increase in the number of structures that are commonly referred to as "monster homes," which are large-scale homes that are designed to house several families, but are situated on property zoned for single-family residential use; and

 

     WHEREAS, these monster homes are very large multi-level residential structures, with some homes reported to have as many as twenty-five bedrooms; and

 

     WHEREAS, these monster homes are often built to the limits of lot lines and to the maximum permissible height; and

 

     WHEREAS, the construction of monster homes in single-family home neighborhoods have raised many concerns, including concerns about possible violations of permitting and zoning laws, a lack of appropriate certificates of occupancy, and illegal modification of structures to create additional units; and

 

     WHEREAS, residents of neighborhoods in which monster homes are located often note an increase in noise and traffic, a reduction in available public parking, a strain on the existing community and surrounding infrastructure, increased building density in the neighborhood, and erosion of the neighborhood's character; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Thirtieth Legislature of the State of Hawaii, Regular Session of 2019, the Senate concurring, that the Director of the Office of Planning is requested to convene a task force, within the Department of Business, Economic Development, and Tourism for administrative purposes, to determine ways that the State can assist the City and County of Honolulu in deterring the construction of monster homes; and

 

     BE IT FURTHER RESOLVED that the task force be composed of the following members:

 

     (1)  The Director of the Office of Planning, or the Director's designee, who shall serve as the chairperson of the task force;

 

     (2)  The Attorney General, or the Attorney General's designee;

 

     (3)  The Director of Commerce and Consumer Affairs, or the Director's designee;

 

     (4)  A member of the Senate appointed by the President of the Senate;

 

     (5)  A member of the House of Representatives appointed by the Speaker of the House of Representatives;

 

     (6)  The Mayor of the City and County of Honolulu, or the Mayor's designee;

 

     (7)  The Director of Planning and Permitting of the City and County of Honolulu, or the Director's designee;

 

     (8)  The Corporation Counsel of the City and County of Honolulu, or the Corporation Counsel's designee;

 

     (9)  The Prosecuting Attorney of the City and County of Honolulu, or Prosecuting Attorney's designee;

 

    (10)  A member of the Honolulu City Council appointed by the Chairperson of the Honolulu City Council; and

 

    (11)  Any other government official whose inclusion the Director of the Office of Planning believes would benefit the task force; and

 

     BE IT FURTHER RESOLVED that the Director of the Office of Planning is requested to invite various representatives of the construction industry and members of the public to be members of the task force; and

 

     BE IT FURTHER RESOLVED that the task force is requested to submit a report of its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2020; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of the Office of Planning, Attorney General, Director of Commerce and Consumer Affairs, President of the Senate, Speaker of the House of Representatives, Mayor of the City and County of Honolulu, Director of Planning and Permitting of the City and County of Honolulu, Corporation Counsel of the City and County of Honolulu, Prosecuting Attorney of the City and County of Honolulu, and the Chairperson of the Honolulu City Council.
