HOUSE CONCURRENT

RESOLUTION

 

 

urging the department of public safety to establish a habitual criminal offender registry.

 

 

 


     WHEREAS, many convicted criminal offenders living in the community have committed multiple offenses; and

 

     WHEREAS, past behavior can be an accurate predictor of future behavior; and

 

     WHEREAS, criminals who have been convicted of multiple crimes may be accurately characterized as habitual offenders; and

 

     WHEREAS, certain information about an individual's criminal convictions is generally available to the public; and

 

     WHEREAS, many members of the public do not have the time or expertise to compile information about criminal offenders; and

 

     WHEREAS, information about criminal offenders that is publicly available may not include pertinent, current, and accurate details about an offender, including the area in which the offender resides; and

 

     WHEREAS, many members of the public would like more information about criminal offenders to be easily accessible so that they may take appropriate steps to safeguard themselves, their families, their neighbors, and their property; and

 

     WHEREAS, some members of the public share information about criminal offenders through social media; and

 

     WHEREAS, information shared through social media may not always be accurate; and

 

     WHEREAS, accurate information about criminal convictions is readily available to law enforcement agencies; and

 

     WHEREAS, the State operates an online registry of sex offenders that may be reviewed by members of the public; and

 

     WHEREAS, several states operate online habitual offender registries that allow the public to access information about persons who have been convicted at least five times for driving under the influence of alcohol or drugs and meet certain other criteria; and

 

     WHEREAS, persons sentenced to terms of incarceration in Hawaii after being convicted of violating state criminal laws are generally confined by the Hawaii Department of Public Safety; and

 

     WHEREAS, the Department of Public Safety has access to information about a criminal offender's convictions, incarceration, and release into the community;

now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-eighth Legislature of the State of Hawaii, Regular Session of 2016, the Senate concurring, that the Department of Public Safety is urged to establish an online habitual offender registry that may be accessed by members of the public; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Director of Public Safety.
