HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING THE LEGISLATIVE REFERENCE BUREAU TO STUDY THE ADEQUACY OF INSURANCE COVERAGE REQUIREMENTS FOR TRANSPORTATION NETWORK COMPANIES AND TRANSPORTATION NETWORK COMPANY DRIVERS.

 

 

 


     WHEREAS, Act 236, Session Laws of Hawaii 2016, was intended to close the insurance gaps associated with transportation network companies by establishing motor vehicle insurance requirements for transportation network companies and transportation network company drivers; and

 

     WHEREAS, while Act 236, Session Laws of Hawaii 2016, requires the Insurance Commissioner to conduct an annual study and report to the Legislature on the impact of Act 236 on personal motor vehicle insurance policy rates in the State, Act 236 does not require the Insurance Commissioner to study the adequacy of coverage required under Act 236 for claims arising from accidents involving transportation network companies and transportation network company drivers; and

 

     WHEREAS, Act 236, Session Laws of Hawaii 2016, will be repealed on September 1, 2021; and

 

     WHEREAS, in addition to the effect on insurance rates, it is important to determine whether the insurance coverage requirements for transportation network vehicles and transportation network company drivers are adequate to cover claims by passengers, drivers, and members of the public, including other drivers and pedestrians, who may suffer injury, death, or property damage as a result of motor vehicle accidents involving transportation network companies and transportation network company drivers; now, therefore,

     BE IT RESOLVED by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2018, the Senate concurring, that the Legislative Reference Bureau is requested to study the adequacy of insurance coverage requirements for transportation network companies and transportation network company drivers; and

 

     BE IT FURTHER RESOLVED that in completing the study, the Legislative Reference Bureau is requested to consider, among other things:

 

     (1)  The insurance coverages required by the Department of Transportation for airport permit holders;

 

     (2)  The insurance coverages required by the various counties for taxicabs and taxicab drivers; and

 

     (3)  The insurance coverages required by the Public Utilities Commission for commercial vehicles and commercial vehicle operators; and

 

     BE IT FURTHER RESOLVED that the Legislative Reference Bureau is requested to submit a report of its findings and recommendations, including any necessary proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2019; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Director of the Legislative Reference Bureau.
