A BILL FOR AN ACT

 

 

relating to public access to the shoreline in south Maui.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  Public access to the shoreline is an important common law right shared and enjoyed by residents of and visitors to Hawaii alike.  The right of access to the State's shorelines includes the right of transit along the shoreline and within beach transit corridors.  The legislature finds that there is a parcel of state-owned land in south Maui that lacks adequate shoreline access.

The purpose of this Act is to expand public access to the shoreline in south Maui by:

     (1)  Requiring the department of land and natural resources, in collaboration with the county councilmember representing the south Maui residency area, Kihei Community Association, and Aha Moku O Kula Makai, to develop a master plan to expand public access to the shoreline in south Maui, particularly to state-owned land; and

     (2)  Appropriating funds for this purpose.

     SECTION 2.  (a)  The department of land and natural resources, in collaboration with the county councilmember representing the south Maui residency area, Kihei Community Association, and Aha Moku O Kula Makai, shall develop a master plan to expand public access to the shoreline in south Maui, particularly to state-owned land.

     (b)  The department of land and natural resources shall submit the master plan, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2020.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2019-2020 for the development of a master plan to expand public access to the shoreline in south Maui, particularly to state-owned land.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2019.
