A BILL FOR AN ACT

 

 

relating to ENVIRONMENTAL PROTECTION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the use of fossil fuels is the State's primary contributor to greenhouse gas emissions in the atmosphere.  The legislature further finds that, under the Hawaii Clean Energy Initiative, the State has a goal of reducing the consumption of petroleum in ground transportation by approximately three hundred eighty-five million gallons per year.  Additionally, the mayors of all counties have established a clean ground transportation goal of being one hundred per cent clean by 2045.

     The purpose of this Act is to accelerate the transition of the State's ground transportation to clean transportation alternatives by prohibiting the sale or offer for sale of new motor vehicles that are solely powered by fossil fuels and designed for personal, family, or household use.

     SECTION 2.  Chapter 437, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§437-     Prohibition on the sale of new motor vehicles solely powered by fossil fuels.  (a)  Beginning January 1, 2035, no new motor vehicle dealer or salesperson shall sell or offer for sale a new motor vehicle that:

     (1)  Is solely powered by fossil fuels; and

     (2)  Is designed for personal, family, or household use.

     (b)  This section shall not be construed to:

     (1)  Prohibit the sale or offer for sale of new motor vehicles designed for commercial use, including but not limited to buses and truck-tractors;

     (2)  Prohibit the sale or offer for sale of used motor vehicles after December 31, 2034; or

     (3)  Prohibit the sale or offer for sale of new motor vehicles partially powered by fossil fuels after December 31, 2034."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
