A BILL FOR AN ACT

 

 

relating to service animals.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 347, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§347-     Knowing misrepresentation as owner or trainer of service dog; penalty.  (a)  Any person who knowingly and fraudulently represents the person, through verbal or written notice, as the owner or trainer of a dog that is qualified as or identified as a service dog shall be guilty of a misdemeanor punishable by imprisonment for not more than six months or a fine of not more than $1,000, or both.

     (b)  As used in this section, "owner" means any person who owns a service dog or who is authorized by the owner to use the service dog."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
