STATE OF HAWAII

A BILL FOR AN ACT

 

 

relating to the hawaii community correctional center.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  (a)  There is established a Hawaii community correctional center task force within the department of public safety for administrative purposes.  The task force shall study and recommend to the legislature a site for a new jail to replace the Hawaii community correctional center's primary facility on three acres in downtown Hilo, Hawaii, and consider alternative governmental uses for the existing site.  The work of the task force shall also include but not be limited to:

     (1)  Determining the appropriateness of potential new sites for a right-sized facility, including land acquisition and development costs, adequacy of existing infrastructure, impacts on the surrounding community and land uses, proximity to courts and police, and other related factors;

     (2)  Examining the adequacy of the existing facility to accommodate underserved governmental services, costs of improvements that may be needed to ready the facility for alternative uses, and the impacts of proposed alternative governmental uses on the surrounding community and land uses;

     (3)  Determining any proposed legislation or funding requests necessary for the purposes of this Act; and

     (4)  Examining other relevant information deemed necessary by the director of public safety.

     (b)  The task force shall consist of the following members:

     (1)  The director of public safety, or the director's designee;

     (2)  The mayor of the county of Hawaii, or the mayor's designee;

     (3)  The planning director of the county of Hawaii, or the director's designee;

     (4)  The chief of police for the county of Hawaii, or the chief's designee;

     (5)  The warden of the Hawaii community correctional center, or the warden's designee; and

     (6)  Any other agency or community representatives deemed appropriate by the director of public safety.

     (c)  The task force's meeting schedule shall be determined by its members.

     (d)  The task force shall be exempt from chapter 92, Hawaii Revised Statutes.

     (e)  Task force members shall serve without compensation but shall be reimbursed for necessary expenses, including travel expenses, incurred for service on the task force.

     SECTION 2.  (a)  The director of public safety, in consultation with the task force, shall submit a report of the task force's findings and recommendations, including any proposed legislation and funding requests, to the legislature no later than twenty days prior to the convening of the regular session of 2022.

     (b)  The task force shall be dissolved on June 30, 2022.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2021-2022 to carry out the purposes of this Act.

     The sums appropriated shall be expended by the department of public safety for the purposes of this Act.

     SECTION 4.  This Act shall take effect upon its approval; provided that section 3 shall take effect on July 1, 2021.
