A BILL FOR AN ACT

 

 

relating to insurance.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 431, article 10A, Hawaii Revised Statutes, is amended by adding two new sections to part I to be appropriately designated and to read as follows:

     "§431:10A-A  Extension of dependent coverage.  Every individual accident and health or sickness insurance policy that provides dependent coverage of children shall continue to make that coverage available for an unmarried adult child until the child turns twenty-six years of age or gets married, whichever occurs first.  Nothing in this section shall require the plan or policy to make coverage available for a child of a child that receives dependent coverage.

     §431:10A-B  Prohibition of preexisting condition exclusions.  No individual accident and health or sickness insurance policy may impose any preexisting condition exclusion with respect to the plan or coverage."

     SECTION 2.  Chapter 431, article 10A, Hawaii Revised Statutes, is amended by adding two new sections to part II to be appropriately designated and to read as follows:

     "§431:10A-C  Extension of dependent coverage.  Every group accident and health or sickness insurance policy that provides dependent coverage of children shall continue to make that coverage available for an unmarried adult child until the child turns twenty-six years of age or gets married, whichever occurs first.  Nothing in this section shall require the plan or insurer to make coverage available for a child of a child that receives dependent coverage.

     §431:10A-D  Prohibition of preexisting condition exclusions.  No group accident and health or sickness insurance policy may impose any preexisting condition exclusion with respect to the plan or coverage."

     SECTION 3.  Chapter 432, article 1, Hawaii Revised Statutes, is amended by adding two new sections to part VI to be appropriately designated and to read as follows:

     "§432:1-     Extension of dependent coverage.  Every individual and group hospital or medical service plan contract that provides dependent coverage of children shall continue to make that coverage available for an unmarried adult child until the child turns twenty-six years of age or gets married, whichever occurs first.  Nothing in this section shall require the plan contract to make coverage available for a child of a child that receives dependent coverage.

     §432:1-     Prohibition of preexisting condition exclusions.  No individual or group hospital or medical service plan contract may impose any preexisting condition exclusion with respect to the plan contract."

     SECTION 4.  Section 432D-23, Hawaii Revised Statutes, is amended to read as follows:

     "§432D-23  Required provisions and benefits.  Notwithstanding any provision of law to the contrary, each policy, contract, plan, or agreement issued in the State after January 1, 1995, by health maintenance organizations pursuant to this chapter, shall include benefits provided in sections 431:10-212, 431:10A-115, 431:10A-115.5, 431:10A-116, 431:10A-116.2, 431:10A-116.5, 431:10A-116.6, 431:10A-119, 431:10A-120, 431:10A-121, 431:10A-122, 431:10A-125, 431:10A-126, 431:10A-132, 431:10A-133, 431:10A-140, [and] 431:10A-134, 431:10A-A, 431:10A-B, and chapter 431M."

     SECTION 5.  In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 6.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 7.  This Act shall take effect upon the repeal of the Patient Protection and Affordable Care Act, Public Law 111-148.
