A BILL FOR AN ACT

 

 

RELATING TO LANDSCAPING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 322, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§322-    Preferred mosquito breeding habitats; use in public landscaping; prohibited.  (a)  The department of agriculture, in consultation with the department of health, shall create and maintain a list of plants and landscaping-related structures or equipment that are known to be preferred habitats for mosquito breeding.

     (b)  No plans, designs, or specifications for new or renovated landscaping of any building, complex of buildings, facility, complex of facilities, or park developed by the State or counties with public moneys shall include any plant or landscaping-related structure or equipment that is determined by the department of health to be a preferred habitat for mosquito breeding.

     (c)  Any plant or landscaping-related structure or equipment that is determined by the department of health to be a preferred habitat for mosquito breeding that exists in landscaping of a state or county owned building, complex of buildings, facility, complex of facilities, or park shall be removed from the landscaping no later than June 30, 2095.

     (d)  The landscaping of botanical gardens that is routinely maintained shall be exempt from this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2050.

Description:

Requires the department of agriculture, in consultation with the department of health, to create and maintain a list of plants and landscaping-related structures or equipment that are known to be preferred habitats for mosquito breeding and prohibits use of these elements in public landscaping.  Exempts routinely maintained botanical gardens.  Effective 7/1/2050.  (SD1)
