A BILL FOR AN ACT
relating to the hawaii health systems corporation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 323F, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:
"Part . County Management and Operation of
the east hawaii regional system facilities
§323F-A Transfer of right and responsibility to manage, operate, and provide health care services in a facility of the east Hawaii regional system to the county of Hawaii. Notwithstanding any other law to the contrary, the governor, with the assistance of the chief executive officer of the corporation, and the regional chief executive officer of the east Hawaii regional system, or their designees, shall transfer the right and responsibility to manage, operate, and otherwise provide health care services at one or more facilities of the east Hawaii regional system, including Hilo medical center, to the county of Hawaii.
§323F-B Appropriations to the county of Hawaii for the management and operation of east Hawaii regional system facilities. For the management and operation of the east Hawaii regional system facilities transferred under this part, the State shall make an annual appropriation to the county of Hawaii that is equal to the level of the appropriation made in fiscal year 2016-2017 to the Hawaii health systems corporation for the transferred facilities, as adjusted annually based upon the Consumer Price Index for All Urban Consumers (CPI-U), All Items, for Honolulu.
§323F-C General fund transfers to the county of Hawaii for collective bargaining unit cost adjustments. In addition to the appropriation amounts required under section 323F-B, the State shall also make annual transfers of general funds to the county of Hawaii to pay for any collective bargaining unit cost adjustments of an appropriate bargaining unit until such time that the county of Hawaii, under section 89-6(d), has at least half of the votes of the public employer for the purpose of negotiating a collective bargaining agreement for that bargaining unit."
SECTION 2. The appropriations and general fund transfers under sections 323F-B and 323F-C in section 1 of this Act shall be made in satisfaction of article VIII, section 5, of the state constitution, on the transfer of mandated programs.
SECTION 3. In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.
SECTION 4. This Act shall take effect upon its approval.
