A BILL FOR AN ACT

 

 

relating to parking requirements.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-    Accessory dwelling unit parking stall requirements; public transit; exemption.  (a)  No county shall impose an off-street parking space or parking stall requirement on any accessory dwelling unit that is within one-half mile of a public transit facility.

     (b)  For the purposes of this section:

     "Accessory dwelling unit" means a second dwelling unit including separate kitchen, bedroom, and bathroom facilities, attached or detached form the primary dwelling unit on the zoning lot.

     "Public transit facility" includes rail transit stations and bus stops."

     SECTION 2.  New statutory material is underscored.


     SECTION 3.  This Act shall take effect upon its approval.
