A BILL FOR AN ACT

 

 

RELATING TO CAMPAIGN FINANCE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 11, Hawaii Revised Statutes, is amended by adding a new section to part XIII, subpart E, to be appropriately designated and to read as follows:

     "§11-     Fundraisers and solicitations of contributions during legislative session prohibited.  (a)  During the period in which in the legislature is in regular session, no candidate, candidate committee, or noncandidate committee, whether in person, by mail, by telephone, through the internet, or by any other means, shall hold a fundraiser or solicit contributions for the advocacy of the election or defeat of any clearly identified candidate.

     (b)  Any candidate, candidate committee, or noncandidate committee that violates this section shall be subject to a fine of $        , which shall be deposited into the Hawaii election campaign fund.

     (c)  For the purposes of this section, "fundraiser" shall have the same meaning as in section 11-342."

     SECTION 2.  Section 11-409, Hawaii Revised Statutes, is amended to read as follows:

     "[[11-409[]]  Final determination of violation; order.  If the commission makes a final determination of a violation of this part, its written decision with findings of fact and conclusions of law may order any of the following:

     (1)  The return of any contribution;

     (2)  The reimbursement of any unauthorized expenditure;

     (3)  The payment of any administrative fine to the general fund of the State; provided that the payment a fine imposed pursuant to section 11-   (b) shall be made to the Hawaii election campaign fund;

     (4)  The respondent to cease and desist violations of this part; or

     (5)  Any report, statement, or other information to be filed that may be required by this part."

     SECTION 3.  Section 11-421, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The fund shall consist of:

     (1)  All moneys collected from persons who have designated a portion of their income tax liability to the fund as provided in section 235-102.5(a);

     (2)  Any general fund appropriations; [and]

     (3)  All moneys from fines assessed for violations of section 11-   ; and

    [(3)] (4)  Other moneys collected pursuant to this part."

     SECTION 4.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect on July 1, 2019.
