A BILL FOR AN ACT

 

 

relating to electric bicycles.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  The purpose of this Act is to define and regulate electric bicycles.

     SECTION 2.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§291C-     Electric bicycles.  (a)  An electric bicycle shall be treated as a bicycle and operated on bikeways and roadways as a bicycle, except as provided in section 291C-148(b).

     (b)  An electric bicycle shall be registered as a bicycle pursuant to section 249-14."

     SECTION 3.  Section 291C-1, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

     ""Electric bicycle" means any bicycle with an electric motor, which generates less than seven hundred fifty watts, with a top motor-powered speed not in excess of twenty miles per hour, and a total weight of less than one-hundred pounds."

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
