A BILL FOR AN ACT

 

 

relating to gas.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that home safety is of significant importance for families, especially those with children.

     The legislature also finds that recent studies have shown that use of gas appliances can diminish indoor air quality and affect human health, especially developing children.  Gas appliances commonly lead to gas leaks, which may cause fires or explosions.

     The purpose of this Act is to:

     (1)  Require all dwellings constructed after December 31, 2021, that are serviced by gas utilities to be constructed with gas detection systems installed; and

     (2)  Require notice to prospective buyers about the potential hazards of gas appliances.

     SECTION 2.  Chapter 196, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§196-     Gas detection systems; required.  Beginning January 1, 2022, no building permit shall be issued for a new dwelling for residential use that is serviced by a gas utility that does not include an installed gas detection system."

     SECTION 3.  Chapter 508D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§508D-     Notice; gas appliances.  In addition to the disclosures required by this chapter, when a seller is selling residential real property that is serviced by a gas utility, the seller shall provide a notice to the buyer, which the buyer shall sign and acknowledge, stating that:

     (1)  Gas appliances may cause diminished indoor air quality, which may impact human health; and

     (2)  Gas leaks may cause dangerous fires or explosions."

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
