A BILL FOR AN ACT

RELATING TO PESTICIDES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that in 2013, the Kauai county council passed a county ordinance relating to pesticides and genetically modified organisms. That ordinance also contained a provision to create a joint fact finding study group to help address key environmental and public health questions related to large-scale commercial agriculture entities on Kauai. When the ordinance was first struck down by the lower court in 2014, the department of agriculture and the Kauai county office of the mayor contracted with a public policy group to facilitate the joint fact finding study group. The fact finding mission took place between January 2015 and April 2016, and on May 25, 2016, the study group issued its findings and recommendations.

The purpose of this Act is to appropriate funds to implement the findings and recommendations of the joint fact finding study group's report on pesticide use by large agribusinesses on Kauai.

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 for implementation of the recommendations published in the joint fact finding study group's May 25, 2016, report on pesticide use by large agribusinesses on Kauai.

The sums appropriated shall be expended by the department of agriculture for the purposes of this Act.

SECTION 3. This Act shall take effect on July 31, 2150.
