A BILL FOR AN ACT

 

 

RELATING TO STATE BUILDING CONSTRUCTION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Hawaii is committed to mitigating climate change.  Act 15, Session Laws of Hawaii 2018, reflects this commitment, establishing a statewide target of sequestering more atmospheric carbon and greenhouse gases than are emitted within the State.

     The legislature also finds that concrete is the most widely used construction material in the world because of its low cost, strength, and durability.  The legislature finds that the production of cement, the critical ingredient in concrete, accounts for seven per cent of the world's carbon dioxide.  However, the emission of carbon dioxide from cement production may be offset by injecting carbon dioxide into the concrete during mixing.  This process chemically transforms the carbon dioxide into mineral form, embedding it into the concrete and preventing its release as a gas.

     The purpose of this Act is to work toward the State's emission sequestration target by requiring all state building construction that uses concrete to use post-industrial carbon dioxide mineralized concrete, unless the use of these materials will increase costs or delay construction.

     SECTION 2.  Chapter 107, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§107‑     Use of carbon dioxide mineralized concrete.  All state building construction that requires the use of concrete shall use post-industrial carbon dioxide mineralized concrete unless the use of these materials will:

     (1)  Cost more than the use of concrete; or

     (2)  Delay the completion of the state building construction.

     As used in this section, "post-industrial carbon dioxide mineralized concrete" means concrete that has undergone active carbonation treatment during mixing, in which carbon dioxide is injected into and mineralized within the concrete."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
