A BILL FOR AN ACT

 

 

relating to collective mediation by physicians.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The department of the attorney general shall conduct a feasibility study on whether the legislature may enact legislation to allow competing physicians to meet and communicate in order to collectively mediate with a health benefit plan.  The study shall address any potential federal preemption concerns and legal issues concerning federal antitrust laws. 

     (b)  The department of the attorney general shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2021.

     SECTION 2.  This Act shall take effect on July 1, 2050.
