STATE OF HAWAII

A BILL FOR AN ACT

RELATING TO HEALTH.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the proper certification of dental assistants is necessary to ensure the health, safety, and well-being of the State's citizens. Currently, Hawaii is a part of a small group of states that does not require dental assistants to be certified. The legislature acknowledges that oral health experts should determine the criteria necessary to create a regulatory framework that allows dental assistants to grow their profession while also ensuring patient safety.

The purpose of this Act is to establish a task force to provide recommendations for qualification and certification requirements for dental assistants in Hawaii.

SECTION 2. (a) There is established the dental assistant task force within the department of commerce and consumer affairs for administrative purposes. The task force shall develop and recommend criteria to certify dental assistants in the State.

(b) The task force shall consist of the following members:

(1) The director of commerce and consumer affairs or the director's designee, who shall serve as chairperson;

(2) The director of health or the director's designee;

(3) A member of the board of dentistry; and

(4) One representative from each of the following, to serve at the invitation of the chairperson:

(A) The Hawaii Dental Association;

(B) The Hawaii Dental Hygienists' Association; and

(c) Members of the task force shall serve without compensation, but shall be reimbursed for reasonable expenses incurred, including travel expenses.

(d) The task force shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2021.

(e) The task force shall be dissolved on June 30, 2021.

SECTION 3. This Act shall take effect on July 1, 2050.
