A BILL FOR AN ACT

 

 

relating to sun shade devices.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§291-     Regulation of motor vehicle sun shade devices; penalty(a)  No person shall park any motor vehicle with a sun shade device in place on a public highway from fifteen minutes after sunset until fifteen minutes before sunrise.  Each period from fifteen minutes after sunset until fifteen minutes before sunrise during which the sun shade device remains in place shall constitute a separate offense.

     For the purposes of this section, "sun shade device" means a device made of reflective material placed on the dashboard of a motor vehicle and secured to the windshield of the motor vehicle that is used to reduce the amount of ultraviolet rays entering the motor vehicle as well as the interior heat of the motor vehicle.

     (b)  Any registered owner of a motor vehicle with a sunshade device in place in violation of this section shall be fined up to $200 for each separate offense."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
