A BILL FOR AN ACT
relating to investigations by the attorney general.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 28-2.5, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) The attorney general shall investigate
alleged violations of the law when directed to do so by the governor, or when
the attorney general determines that an investigation would be in the public
interest[.]; provided that it shall be in the public interest to
investigate an alleged violation of state law when:
(1) The alleged
offender is a county police officer; and
(2) The prosecuting attorney of the county that employs the police officer has declined to prosecute the county police officer."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
